All content, materials, and features available on or through the Website, including but not limited to text, graphics, logos, photographs, images, menu designs, recipes (as expressed), audio and video clips, digital downloads, data compilations, and software (collectively, "Content"), are the exclusive property of Pizza Luce or its licensors and are protected by United States and international intellectual property laws, including copyright, trademark, trade secret, and patent laws.
4.1 Trademarks
The name "Pizza Luce," our logo, taglines, and any other distinctive brand identifiers displayed on the Website are trademarks or service marks of Pizza Luce. The Website and its Content are protected by the U.S. Copyright Act (17 U.S.C. § 101 et seq.) and applicable international copyright conventions. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website solely for personal, non-commercial purposes in connection with ordering food or learning about our services. You represent and warrant that you own or have the necessary rights to submit User Content and that it does not infringe any third-party rights or violate any applicable law.
5. Payment Terms
5.1 Pricing
All prices listed on our Website are in United States Dollars (USD) and are subject to change without notice. Prices displayed at the time your order is confirmed will be the prices charged. Applicable sales taxes, delivery fees, and service charges will be calculated and displayed before you complete your purchase.
5.2 Accepted Payment Methods
We accept major credit cards (Visa, MasterCard, American Express, Discover), debit cards, and such other payment methods as may be made available on the Website from time to time. Payment is due in full at the time of order placement for online orders.
5.3 Order Confirmation
Upon successful placement of an order, you will receive an email or on-screen confirmation. This confirmation does not constitute final acceptance of your order; we reserve the right to cancel or modify any order due to product unavailability, pricing errors, or suspected fraud, in which case we will notify you and issue a full refund if payment has been collected.
5.4 Refunds and Cancellations
Orders may be cancelled within a reasonable window before preparation begins. Once food preparation has commenced, cancellations may not be possible. Refunds for quality issues, missing items, or incorrect orders will be evaluated on a case-by-case basis. To request a refund or report an issue, please contact us at [email protected] within 24 hours of receiving your order. We reserve the right to issue refunds in the form of store credit, partial refunds, or full refunds at our discretion.
5.5 Third-Party Payment Processors
We may use third-party payment processors to handle transactions. Your payment information is subject to the privacy policies and terms of those processors. We do not store your full credit card information on our servers. By submitting payment information, you authorize the relevant payment processor to charge the applicable fees to your designated payment method.
6. Food Safety, Allergens, and Nutritional Information
Pizza Luce takes food safety and quality seriously. However, our food is prepared in a kitchen environment where common allergens — including gluten, dairy, eggs, tree nuts, peanuts, soy, and shellfish — are present. We cannot guarantee that any menu item is entirely free from cross-contamination with allergens.
It is your responsibility to inform our staff of any food allergies or dietary restrictions before placing an order. We recommend that customers with severe food allergies consult with our staff directly before ordering. Nutritional information is provided as a general guide and may vary based on preparation methods and ingredient substitutions. Pizza Luce shall not be liable for any adverse reactions resulting from failure to disclose allergies or intolerances.
7. Limitation of Liability
To the fullest extent permitted by applicable law, including the laws of the United States and applicable state law, Pizza Luce, its owners, officers, directors, employees, agents, affiliates, licensors, and service providers shall not be liable for any of the following types of damages arising out of or related to your use of the Website or services:
- Indirect, incidental, special, consequential, or punitive damages;
- Loss of profits, revenues, data, goodwill, or other intangible losses;
- Damages resulting from unauthorized access to or alteration of your transmissions or data;
- Damages resulting from errors, inaccuracies, or omissions in our menu, pricing, or Website content;
- Damages resulting from delays, interruptions, or unavailability of our Website or services;
- Damages arising from third-party conduct, including delivery service partners, payment processors, or other vendors.
In jurisdictions that do not allow the exclusion or limitation of certain types of damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total aggregate liability to you exceed the greater of: (a) the total amount paid by you to Pizza Luce in the twelve (12) months preceding the event giving rise to the claim, or (b) One Hundred Dollars ($100.00 USD).
Nothing in these Terms shall limit liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law, including obligations under the Federal Trade Commission Act (15 U.S.C. § 41 et seq.) and applicable state consumer protection statutes.
8. Disclaimers
THE WEBSITE AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PIZZA LUCE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
- WARRANTIES THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
- WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY CONTENT ON THE WEBSITE;
- WARRANTIES THAT DEFECTS IN THE WEBSITE WILL BE CORRECTED;
- WARRANTIES RELATING TO THE QUALITY, SAFETY, OR SUITABILITY OF FOOD PRODUCTS BEYOND WHAT IS REQUIRED BY APPLICABLE FOOD SAFETY LAW.
We do not warrant the accuracy of nutritional information, allergen disclosures, or ingredient listings provided on the Website, as formulations and preparations may change. You assume full responsibility for your use of the Website and any reliance on information contained therein.
9. Indemnification
You agree to defend, indemnify, and hold harmless Pizza Luce and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms or any applicable law or regulation;
- Your use of the Website or services in a manner not expressly authorized by these Terms;
- Your infringement of any intellectual property or other rights of any person or entity;
- Your submission of false, inaccurate, or fraudulent information;
- Any User Content you submit, post, or transmit through the Website;
- Your negligence, misconduct, or breach of any obligation owed to us or any third party in connection with your use of our services.
We reserve the right, at our expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you. In such case, you agree to cooperate fully with our defense of such claim and not to settle any matter without our prior written consent.
10. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the laws of the state in which Pizza Luce's principal place of business is located, without regard to its conflict of law provisions.
Any legal action or proceeding arising out of or relating to these Terms or your use of our Website or services that is not subject to arbitration under Section 11 shall be brought exclusively in the federal or state courts of competent jurisdiction in the state where Pizza Luce is registered and operating. You hereby consent to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts.
Our services are operated from within the United States. We make no representation that our Website or services are appropriate or available for use outside of the United States. If you access our Website from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your local jurisdiction.
These Terms are subject to all applicable federal laws of the United States, including, without limitation, the Federal Trade Commission Act (15 U.S.C. § 41 et seq.) concerning unfair or deceptive acts or practices, the Electronic Communications Privacy Act, the Computer Fraud and Abuse Act, and any other applicable federal consumer protection statutes.
11. Dispute Resolution
11.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to first contact Pizza Luce in writing at [email protected] and describe your concern in reasonable detail. We will attempt to resolve the dispute informally within thirty (30) calendar days of receipt of your written notice. This informal resolution process is a prerequisite to filing any arbitration demand or legal action.
11.2 Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
If the parties are unable to resolve a dispute through informal means within the thirty (30) day period, any dispute, controversy, or claim arising out of or relating to these Terms, the breach thereof, or your use of our services shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as otherwise provided herein. The arbitration shall be conducted in the state where Pizza Luce maintains its principal place of business, unless the parties mutually agree to a different location or to conduct the arbitration via telephone or videoconference.
The arbitrator shall have authority to award any relief that would be available in a court of law, subject to the limitations set forth in these Terms. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
11.3 Class Action Waiver
YOU AND PIZZA LUCE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR MASS ACTION PROCEEDING. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of class or representative proceeding.
11.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to protect its intellectual property rights or prevent imminent harm pending the outcome of arbitration. Small claims court actions, where the amount in controversy falls within the jurisdictional limits of the applicable small claims court, are also exempt from the arbitration requirement.
11.5 Jury Trial Waiver
TO THE EXTENT ANY DISPUTE IS NOT SUBJECT TO ARBITRATION AND IS INSTEAD LITIGATED IN COURT, BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL WITH RESPECT TO SUCH DISPUTE.
12. Term and Termination
These Terms of Service are effective from the moment you first access the Website or use our services and shall remain in effect until terminated as provided herein.
12.1 Termination by You
You may terminate your account or cease using our services at any time by contacting us at [email protected]. Termination does not relieve you of any obligations incurred prior to termination, including payment for orders placed.
12.2 Termination by Pizza Luce
We reserve the right to suspend or permanently terminate your access to the Website or services at our sole discretion, without prior notice or liability, for any reason, including but not limited to:
- Violation of any provision of these Terms;
- Conduct that we determine, in our reasonable judgment, to be harmful to other customers, our employees, or our business interests;
- Submission of fraudulent orders or payment disputes without legitimate basis;
- Any activity that violates applicable federal, state, or local law.
12.3 Effect of Termination
Upon termination, your right to access and use the Website and services immediately ceases. All provisions of these Terms which by their nature should survive termination — including, without limitation, intellectual property rights, disclaimers, indemnification obligations, limitation of liability, and dispute resolution — shall survive termination.
13. Third-Party Links and Services
Our Website may contain links to third-party websites, platforms, or services — including but not limited to third-party food delivery platforms, social media pages, review sites, and payment processors — that are not owned or controlled by Pizza Luce. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
We strongly encourage you to review the terms of service and privacy policies of any third-party sites you visit. Your interactions with third-party platforms are solely between you and the relevant third party, and Pizza Luce shall not be liable for any loss or damage arising from such interactions.
14. Privacy Policy
Your use of our Website and services is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Our Privacy Policy describes how we collect, use, disclose, and protect your personal information. To the extent applicable, our data practices are governed by the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), for California residents, and by applicable federal privacy laws and the FTC Act's prohibitions on unfair or deceptive practices.
By using our Website, you acknowledge that you have read and understood our Privacy Policy. If you have any questions regarding our data practices, please contact us at [email protected].
15. Changes to Terms
Pizza Luce reserves the right to modify, amend, update, or replace these Terms of Service at any time and at our sole discretion. When we make material changes to these Terms, we will provide notice through one or more of the following means:
- Posting the revised Terms on our Website with an updated "Last Updated" date;
- Sending an email notification to the address associated with your account;
- Displaying a prominent notice on our Website homepage or ordering interface.
Your continued access to or use of the Website or services after the effective date of any revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must immediately discontinue your use of our Website and services and notify us of your intent to terminate at [email protected].
We encourage you to review these Terms periodically to stay informed of any updates. The most current version of the Terms will always be available at lucespizza.digital.
16. Severability
If any provision, clause, or portion of these Terms of Service is held by a court of competent jurisdiction or an arbitrator to be invalid, illegal, void, unenforceable, or contrary to applicable law, such provision shall be deemed severed from these Terms to the minimum extent necessary, and the remainder of these Terms shall continue in full force and effect as if such invalid, illegal, or unenforceable provision had never been included herein.
The parties agree that any court or arbitrator having jurisdiction may reform any invalid or unenforceable provision to the minimum extent necessary to make it enforceable and consistent with the original intent of the parties, to the extent such reformation is permissible under applicable law.
17. Waiver
No failure or delay by Pizza Luce in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. No waiver by Pizza Luce of any particular breach or default shall be deemed a waiver of any subsequent breach or default of the same or any other nature. All waivers must be made in writing and signed by an authorized representative of Pizza Luce to be effective.
18. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other policies or agreements expressly incorporated herein by reference, constitute the entire agreement between you and Pizza Luce with respect to the subject matter hereof and supersede all prior and contemporaneous understandings, agreements, representations, and warranties — whether written or oral — relating to such subject matter.
No representations, warranties, promises, or inducements have been made by either party that are not embodied in these Terms. These Terms may not be modified except in writing signed by an authorized representative of Pizza Luce or as otherwise provided in Section 15 (Changes to Terms).
19. Force Majeure
Pizza Luce shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, governmental actions, civil unrest, strikes or labor disputes, power outages, internet service disruptions, supply chain failures, or other events that could not reasonably have been anticipated or prevented. In the event of a force majeure occurrence, we will endeavor to notify affected customers and resume normal operations as promptly as reasonably practicable.
